Welcome to our Site. These are our Terms & Conditions for use of the Site which you may access in several ways, including but not limited to the web, PDAs, and mobile phones.

Use of this site

  1. The Buy Recycled Business Alliance (BRBA) is the owner and operator of this Site.
  2. Your use of this Site indicates your acceptance of these Terms & Conditions and that you agree to be bound by them.
  3. BRBA reserves the right at any time and from time to time to change these Terms and Conditions. Such changes shall be effective immediately upon posting the amended Terms and Conditions to the Site and your continued use of the Site following such posting will mean that you accept, and agree to be bound by, those changes.
  4. BRBA reserves the right at any time and from time to time to modify the Site or to discontinue, temporarily or permanently, operation of the Site.
  5. BRBA reserves the right at any time and from time to time to deny or restrict access to the Site to any person without ascribing any reason whatsoever.

Definitions

  1. The following terms are utilised in the Directory for the Site and have specific meanings. By agreeing to these Terms and Conditions you acknowledge that you have read and understood the definitions provided below.
    1. Reused Material - A product that is utilised more than once for the same purpose for which is was originally conceived.
    2. Remanufactured Material - A remanufactured product is not new, but composed of both new and restored components. Remanufacturing is the process of the disassembly of products known to be worn, defective, or discarded that can be reused or brought up to original equipment manufacture specification by cleaning, repairing or replacing in a manufacturing environment, and then reassembled to sound working condition, and tested. The remanufactured product is ready for a second life, performing as new. The components used for replacement may be new, recycled content or rebuilt themselves. Please indicate the percentage of the total product that is the original component
    3. Pre-consumer material - Material diverted from the waste stream during a manufacturing process. Excluded is reutilisation of materials such as rework, regrind or scrap generated in a process and capable of being reclaimed within the same process that generated it.
    4. Post-consumer material - Materials generated by households or by commercial, industrial and institutional facilities in their role as end users of a product which can no longer be used for its intended purpose. This includes returns of materials from the distribution chain.
    5. Reutilised materials - Materials such as rework, regrind and scrap generated in a manufacturing process, and reclaimed within the same process that generated it. Note: Standards Australia excludes reutilised materials from the definition of pre-consumer recycled material. This category is however included in the database as it is recognised many companies make significant investments to improve processing technologies to allow company waste to be reutilised and hence removed from the waste stream.
    6. Recyclability (recyclable, end-of-life recyclability) - A characteristic of a product, packaging or associated component that can be diverted from the waste stream through available processes and programmes and can be collected, processed and returned to use in the form of raw materials or products.
    7. Quality Standards - A Standard is a published document which sets out specifications and procedures designed to ensure that a material, product, method or service is fit for its purpose and consistently performs in the way it was intended. Standards establish a common language which defines quality and establishes safety criteria.
    8. Recycled material - Material that has been reprocessed from recovered (reclaimed) material by means of a manufacturing process and made into a final product or into a component for incorporation into a product.
    9. Recycled content - Proportion, by mass, of recycled material in either a product OR packaging. Note: the weight and recycled content of a product’s packaging CANNOT be included in the product calculations. Packaging information should be supplied separately where applicable.

Intellectual Property

  1. All intellectual property in relation to content on this Site belongs to BRBA or its licensors, advertisers or affiliates. You obtain no interest in that intellectual property. All content on this Site is protected by Australian and international copyright and other intellectual property laws. You may not do anything which interferes with or breaches those laws or the intellectual property rights in the content.
  2. You may download and view content or print a copy of material on this Site for personal and commercial use provided you do not modify the content in any way (including any copyright notice). All rights not expressly granted under these terms of use are reserved by BRBA. Unless expressly stated otherwise, you are not permitted to copy, or republish anything you find on the Site without the copyright or trademark owners’ permission.
  3. The BRBA logo and the logos of BRBA are registered trademarks of BRBA or the respective business. Other trademarks may be displayed on the Site from time to time. These may belong to third parties. Nothing displayed on the Site should be construed as granting any license or right of use of any logo, trademark or masthead displayed on the Site, without the express written permission of the relevant owner.

Liability & Indemnity

  1. The Site and all information, data, text, graphics, photographs, audio, software programs, links and other material located at, or accessible by, the Site ("the Content") is provided on an "as is" basis and BRBA does not warrant and hereby disclaims to the full extent permitted by law any implied warranty, condition or representation:
    1. as to the accuracy, completeness, currency, reliability, merchantability, fitness for purpose or quality of the Site or the Content;
    2. that the Content or use of the Site will be uninterrupted or error free;
    3. that the Site and its server will be free of viruses, worms, trojan horses, or other harmful elements.
  2. To the extent permitted by law, BRBA and its employees, officers, agents and contractors will have no responsibility or liability for any loss or damage (including without limitation, indirect, special or consequential loss or damage) arising from your use of, or reliance upon the Site or the Content whether or not this is caused by a negligent act or omission.
  3. To the extent that BRBA is prohibited at law from excluding any other representations, conditions or warranties or from excluding its liability, BRBA and each party providing Content limits its liability to the extent permitted by law, to the resupply of the Content.
  4. You indemnify BRBA and its affiliated companies, and each of their directors, officers, employees and agents against any action, claim, loss or expense which it incurs which arises from your use of the Site.

Third Party Content & Links

  1. This site may include third party content which is subject to that third party's terms and conditions of use. Nothing on this Site should be construed as granting any license or right for you to use that content.
  2. This site may include links to third party sites which are not related to BRBA and in relation to which BRBA has no control or interest. The appearance of those links on this site does not indicate any relationship between BRBA and that third party or any endorsement by BRBA of that third party, its site or the products or services which it is advertising on this Site.

General

  1. Users will not use this Site or the Content for any purpose or in any way which is unlawful. 
  2. Any waiver of any right of a party of this Agreement must be in writing and signed by that party. Any delay to exercise, or part-exercise of any right, does not amount to any waiver.
  3. This Agreement is to be interpreted in accordance with the laws of New South Wales. The parties irrevocably and unconditionally submit to the non-exclusive jurisdiction of the Courts of New South Wales.
